Terms of Service

1. Agreement

These Terms of Service form a binding agreement between you and Anatolie Turcan, who operates Nightspar. You accept them when you register for an account (as part of sign-up) and by using the service. If you do not agree, please do not use Nightspar.

2. The service

Nightspar is a language-learning application: you save words and phrases, they are enriched by AI, and spaced-repetition flashcards help you review them. It is available as a web app, a browser extension, and an MCP server.

Beta notice. Nightspar is pre-release software provided on an "as is" and "as available" basis. Features may change, break, or be removed, and the service may be suspended or shut down. Although we keep backups, data loss is possible, and we offer no service-level guarantee. Please keep your own copy of anything important to you.

3. Eligibility

You must be at least 18 years old to use Nightspar. You may hold one account, and you agree to provide accurate registration information and keep it up to date.

4. Your content & ours

You retain any rights you have in the content you save. You grant us a worldwide, non-exclusive, royalty-free license to host, store, process, and transmit that content — including sending it to our AI providers — solely to provide, secure, maintain, and troubleshoot the service for you.

You are responsible for the content you save. In particular, you must not capture or save content that you do not have the right to process, and you must not use the context-capture feature to collect content you are not permitted to.

Nightspar itself — the software, design, branding, and the service components we generate — remains our property. These terms do not grant you any rights to it beyond using the service.

5. AI-generated content

Enrichment — meanings, translations, examples, and pronunciation — is generated by AI and may be inaccurate, incomplete, or out of date. It is a learning aid, not professional translation or advice, and we make no warranty as to its accuracy. Please verify anything you rely on.

6. Acceptable use

You agree not to:

• Abuse or overload the AI enrichment features.
• Use the service in an automated or bulk way outside the provided surfaces (the app, extension, and MCP server).
• Upload or save unlawful content.
• Reverse-engineer, probe, or attack the service or its security.

7. Fees

Nightspar is free to use during the beta. We may introduce paid plans in the future, and we will give you advance notice before any charges apply to you.

8. Suspension & termination

You may stop using Nightspar and delete your account at any time from your account settings. Deleting your account immediately removes your account and content; residual encrypted backups and third-party service records expire according to the periods described in our Privacy Policy. We may suspend or terminate your access for violations of these terms, and we may discontinue the beta. When your account is terminated, your content is deleted the same way.

9. Disclaimers & limitation of liability

To the maximum extent permitted by law, the service is provided without warranties of any kind, and we are not liable for any indirect, incidental, or consequential damages, or for any loss of data, arising from your use of the service.

Nothing in these terms excludes or limits liability that cannot be excluded or limited under applicable law, including certain rights you may have as a consumer under EU law.

10. Changes to these terms

We may update these terms from time to time. For material changes, we will notify you in the app or by email before they take effect, and if you do not agree you can stop using Nightspar and delete your account. Your continued use of Nightspar after a change takes effect means you accept the updated terms.

11. Governing law

These terms are governed by the laws of the Republic of Moldova, and any disputes will be subject to the courts of that jurisdiction, without prejudice to any mandatory consumer-protection rights you have where you live.
